Network Rail has been fined £130,000 and Scotweld Employment Services £33,000 following the death of a worker, Ian Gilmour, in April 2005.
Gilmour was struck by a train at Newbridge Junction, near Edinburgh, where he had been acting as a lookout. Network Rail had failed to ensure track inspections were planned and carried out safely and had not provided Scotweld with necessary safety information. Scotweld had failed to request a safety pack, exposing three of its employees to unnecessary risk.
Both companies pleaded guilty at Edinburgh Sheriff's court to breaching the Health and Safety at Work Act. The sheriff accepted that the companies had cooperated since the accident to prevent a repeat.
