I have been informed that a colleague who broke her leg in four places four weeks ago wishes to return to work on a part-time basis. She is wearing a cast and has to sit with her leg up, and sticking out. Could you outline the legal position with regards to this situation, as your advice will help in the forthcoming meeting with senior management?

If the employee's doctor feels that she is well enough to return to work, despite her mobility impairment, the legal position would be to ensure that she can safely carry out her job without putting herself at increased risk, as required under the Health and Safety at Work, etc Act 1974.

One way of achieving this would be to carry out a personal risk assessment. Considerations should include fire evacuation arrangements, the employee's use of the building and facilities and the working activity itself.

Controls and measures you might wish to adopt include:
? an occupational health return-to-work assessment;
? a return-to-work plan;
? light or alternative duties during the recovery period;
? a buddy system or evac chair in the event of a fire evacuation;
? increasing the work space available;
? altering work methods and the working environment if considered reasonable and practical; and
? supplying equipment to improve safety.
