I work for a firm which doesn't currently have any disabled persons in its employment, and the general public doesn't have regular access to the building. Am I able to remove a disabled toilet currently present within my place of work?

As it is anticipated that the general public will not have access to the building or the facilities contained within the building, the scope of part III (duties for service providers) of the Disability Discrimination Act (DDA) 1995 will not apply to you.

It is considered best practice for employers to provide disabled toilets, but you are not legally required to have one in place if you do not currently employ any workers with disabilities.

The DDA will apply to employers should they employ a disabled person - it is then the duty of the employer to make reasonable adjustments to workplaces, practices and procedures that will assist a disabled person in doing his/her job. One of these may be the provision of a disabled access toilet. A duty to make provisions for a disabled employee will only arise if they commence work with you. This will then be a legal requirement.
